Terms and Conditions

  1.  Introduction
    1. Direction Tutors, LLC, d/b/a Michael Jordan College Prep (“MJ College Prep”/“MJ Prep”) is an active business in the State of Texas.
    2. Throughout this document, “We” and “Our” refers to MJ Prep, its staff, and its employees. “You” and “Your” refers to the client reading this or receiving our services.
    3. MJ Prep reserves the right, in its sole discretion, to change these Terms, in whole or in part, at any time. Changes in these Terms will be effective when posted.
  2. Confidentiality
    1. We agree not to provide your information to a third party under any circumstance not authorized by the law or by you.
    2. You understand that all course materials and methods are the exclusive property of MJ Prep. You agree not to disclose, reproduce, sell, or otherwise distribute any information obtained from MJ Prep.
  3. Tutors
    1. All of our tutors are legally authorized to work in the United States and have passed criminal background checks. Our recruitment process is thorough and ensures that only high-quality tutors are employed. We accept no liability for any grievances that occur in a tutoring session.
    2. If you are not happy with the tutor we have assigned to you, please contact MJ Prep before your second tutoring session. We will assign a new tutor and not charge you for your first session with your original tutor. If you request a change in the tutor assigned to you after your second tutoring session, we will charge you for all hours used.
  4. Cancellations/Missed Appointments/Tardiness
    1. Sessions are expected to start and end as scheduled regardless of the time of your arrival. No adjustment to fees shall be made for time lost due to your tardiness or need to leave early.
    2. We send confirmation emails, reminder emails, and reminder texts to students for every appointment. We will not be held responsible for any student who doesn’t know the time or location of a session.
    3. If you need to cancel a scheduled tutoring session, you must either
      1. Give your tutor notice via email, text, or phone call,
      2. Contact MJ Prep at director@mjprep.com or 877-467-8886, or
      3. Cancel your appointment online

      at least 24 hours in advance of the session. If you fail to give 24 hours’ advance notice of any cancellation, the missed session will be treated as if the session took place and billed 100%.

    4. A parent must be present for the duration of an in-home tutoring session. If a parent isn’t present at the beginning of an in-home tutoring session, the session will be cancelled and treated as a no-show.
    5. If an MJ Prep tutor cancels or misses an appointment without giving you 24 hours’ advance notice, you are eligible to receive one free session of equivalent hours to the missed session of tutoring in addition to the hours in your program.
    6. If, for any reason, you miss your free consultation, aren’t available for your free consultation, or cancel your free consultation without 12 hours’ notice, a rescheduled consultation will be billed at $150.
  5. Payment
    1. You agree to pay MJ Prep the agreed-upon package or hourly rate for services. You understand that you will be charged for time in half-hour increments. You can pay by credit card online via MJ Prep’s website, our Acuity Scheduling portal, or directly with a tutor, by check mailed to MJ Prep or handed to a tutor, or by cash handed to a tutor.
    2. We charge a bounced check fee of $35.
    3. Sessions purchased either individually or through a discounted package expire after 6 months of inactivity. Expired tutoring hours will neither be redeemable nor refundable.
    4. MJ Prep may permanently cancel your services if you have not paid for your first session (as part of a discounted package or an individual session payment) by your second scheduled session, are, in MJ Prep’s opinion, disruptive in your program, or do not comply with these Terms or other rules and procedures applicable to our services being provided to you.
    5. Prepaid packages are only valid for future sessions. Prepaid packages cannot be applied to past unpaid sessions.
    6. Payment is due at the date of service. Your credit card on file may be charged for any fees more than 30 days past due. Your credit card on file may also be charged for missed sessions and sessions not canceled 24 hours in advance. These transactions may occur without additional notice. Fee payment deadlines are your responsibility. You may be charged a penalty fee if your credit card company denies your credit card.
  6. Refunds
    1. If, after your first session, you are not totally satisfied, we will make every attempt to find you a new tutor (see 4.2 above). If we are unable to find a suitable replacement within a reasonable amount of time, we will refund any pre-paid sessions you have remaining.
    2. Except in the above situation, you agree that at no time will you be eligible for a refund for services to be provided by MJ Prep. This no refund policy is absolute.
  7. Guarantees
    1. You agree not to hold MJ Prep liable for any denied admissions from any educational institution.
    2. We do not guarantee any specific outcomes as a result of tutoring or counseling (admission to any educational institution or test score improvements). We will provide services to help you succeed, but the rest depends on you.
  8. Discontinuation
    1. We reserve the right to discontinue service at any time for any reason.
    2. We may cancel your services if you are, in MJ Prep’s opinion, disruptive in your program or do not comply with these Terms or other rules and procedures applicable to our services being provided to you.
  9. Disputes
    1. Any disputes, claims, or actions arising out of these Terms or any other services of MJ Prep shall be governed by the laws of the State of Texas. Any dispute must be settled by court-ordered mediation and must take place in the State of Texas.
    2. You agree to submit to personal jurisdiction in the Texas courts to resolve any such dispute. In the event of litigation relating to the subject matter of these Terms, the non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs resulting.
